The Will of Samuel Bowlby (9)

Be it remembered that on the eighteenth day of October in the year of our
Lord one thousand eight hundred and fifty two, Edward T. Bowlby appeared before
me, Charles B. Stickney, Judge of the Probate Court in and for the County of
Huron and the State of Ohio and presented for proof approval and record the last
will and testament of Samuel Bowlby, late of Ripley in said county deceased,
which will with the proceedings of proof approval and certificate of probate
there of are with words and figures following to wit.

Will
State of Ohio, Huron County

Ripley September 7th 1850, memorandum of the last will and devise of Samuel
Bowlby as expressed by him on the bed of sickness in the presence of D.E.
Merrill, William Trembly, Thos. Martin and George Noecker, witness as follows and
in the words expressed, that my wife Martha Bowlby have and enjoy all my
property real and personal as long as she shall remain my widow with this exception
only, that I bequeath to my son Edward T. Bowlby one last springs colt and
that after the right of my said wife shall cease, that all of my children shall
share equal in the remaining property or as the law provides as witness my
hand and seal Samuel Bowlby [seal] signed and seated in the presence of D.E.
Merrill, William Trembly, Thomas Martin, George Noecker.

Proof
State of Ohio, Huron County

In open court of probate at Norwalk Ohio Oct. 18,1852 we William Trembly and
Thomas Martin and George Noecker being duly sworn in open court this 18th day
of October A.D. 1852 depose and say that we were present at the execution of
the last will and testament of Samuel Bowlby hereto annexed, we saw the said
testator subscribe said will and heard him publish and declare the same to be
his last will and testament and that the said testator at the time of executing
the same was of full age and of sound mind and memory and not under any
restraint, and that we signed the same as witnesses at his request and in his
presence and in the presence of each other William Trembly, Thos. Martin, George
Noecker. Sworn to and subscribed before me this 18th day of October, 1852 C.B.
Stickney Probate Judge.

Probate
In the matter of Samuel Bowlby's Will

In Probate Court, Huron County, Ohio, the last will and testament of Samuel
Bowlby late of Ripley in said county now deceased was on the 18th day of
October A.D. 1852 produced in said court by Edward T. Bowlby and William Trembly,
Thomas Martin and George Noecker subscribing witnesses to said will appeared in
open court and oath testified to the due execution of said will, which said
testimony was reduced to writing by the court and by them respectively
subscribed and was filed with said will. And it appearing to the court by said
testimony that said will was duly attested and executed, and that the said testator at
the time of executing the same was of full age and of sound mind and memory
and not under any restraint, it is allowed and admitted to probate. Therefore
it is ordered by the Court that said will and testimony and the probate there
of be recorded.

Certificate
State of Ohio, Huron County
I Chas. B. Stickney of the Probate Court in and for said court do certify
that
the foregoing record in the matter of the last will and testament of Samuel
Bowlby deceased contains a full and true copy of said will and of the proof and
probate thereof taken before me as therein set forth as witness my official
signature.
