This Indenture made the twenty seventh day of August in the three & thirtyth year of the Reigne of our Soverigne Lord Charles the second by the Grace of God of England Scotland France & Ireland King defender of the faith ____ Anno _____ 1681 Between Dame Martha Rodes of Barlborough in the County of Derby widow relict of Sir Francis Rodes late of Barlborough Baronet deceased of the one part And Samuel Barker of Barlborough aforesaid in the County of Derby Carpenter of the other part Witnesseth that the said Dame Martha Rodes for and in consideration of the summe of three hundred and fifty pounds of lawful money of England to her in hand & paid by the said Samuel Barker the receipt whereof the said Dame Martha Rodes doth hereby acknowledge & thereof & of own part & parcel thereof doth acquitt Exondate discharge the said Samuel Barker his heirs Executors & administrators every of them for ever by these present hath Granted bargained sold aliened enforced released & confirmed and by these present & of the Gateford in the county of Nottingham And all her third part of the messuages cottage houses edifices buildings barnes stables orchards gardens feedings commons profitt comodities wages paths passages water watercourses woods underwoods meadows pastures closes lands tenements & hereditaments whatsoever of her the said Dame Martha Rodes lying and being within the ________ precinct and _________ of Gateford aforesaid and all her third of all other lands & hereditaments whatsoever formerly conveyed to her the said Dame Martha Rodes and Ciprian Thornton of Grantham in the County of Lincoln Gentleman and Thomas Berry of Grayes Inn in the County of Middlesex Esquire and their heirs by Thomas Lane of London Gentleman To Have and to hold the said third part of the said Manor of Gateford aforesaid and of all & singular the before mentioned messuages lands tenements hereditaments and premises with these and every of them Appurtenances unto the said Samuel Barker his heirs and assigns to the onely sole proper & absolute ______ & behoofe of him the said Samuel Barker his heirs and assigns for ever to be hold of the cheefe Lord or Lords of the fee or fees thereof by the Rents and services therefore formerly _______ and of right Att stoned? to be done for the same And the said Dame Martha Rodes doth grant for her and her heirs that she and her heirs the said third part of the said manor messuages lands tenements hereditaments and premises with their and every of their Appurtenances unto the said Samuel Barker his heirs against her the said Dame Martha Rodes and her heirs and against all and every other person and persons whatsoever lawfully claiming the same or any part thereof by from or under or by from or under the said Sir Francis Rodes her late husband deceased shall and will warrant and for ever defend by those presents And the said Dame Martha Rodes doth for herself & her heirs Executors and Administrators comit promise and grant to and with the said Samuel Barker his heirs and assigns by these present that she the said Dame Martha Rodes is and standeth seized In her ________ as of fee or some other Estate of inheritance of and in the said third part of the said manor messuages lands and premises with the Appurtenances without any condition power limitation of use or uses to alter change or make void the same and that she hath good rightful power and lawful authority to Grant Bargain and sell the same unto the said Samuel Barker his heirs and assigns in manner and form as aforesaid Provided always and upon condition that if the said Dame Martha Rodes her heirs Executors or Administrators or any of them do well and truly contend and pay or cause to be paid fifty pounds with consideration for the same at or repay the first day of September which shall be in the yeare of our Lord God one thousand Six hundred Eighty two That then this present Indenture and everything therein contained shall cease & determin and go uttely void and of non effect to all Intents and purposes whatsoever anything herein contained to the contrary thereof in any wise notwithstanding And the said Dame Martha Rodes doth for herself & her heirs Executors and Administrators and every one of them covenant promise and grant to and with Samuel Barker his heirs Executors and Administrators and every one of them by these present That she the said Dame Martha Rodes her heirs Executors Administrators or Assigns or some of them shall and will well and truly pay or cause to be paid unto the said Samuel Barker his heirs Executors Administrators or Assigns or some of them the said sum of Three hundred and fifty pounds lawfull ________ money with consideration for the same at or upon the first day of September which shall be in the yeare of our Lord God one thousand Six hundred Eighty two According to the true Intent and meaning of these presents And lastly the said Dame Martha Rodes doth for herself & her heirs Executors and Administrators covenant promise and grant to and with Samuel Barker that if default of repayment shall happen to be made of all or any part of this money in the said provisio mentioned according to the true Intent and meaning thereof That hen she the said Dame Martha Rodes shall & will from time to time and at all times hereafter during the space of seven years next coming at the request cost and charges of the said Samuel Barker his heirs and assigns do any further act in the same for the better conveyings the premises to the said Samuel Barker his heirs and assigns as by him his heirs or assigns shall be personally advised and required be it by fine or otherwise and that all and every fine to be levyed of the premises by the said Dame Martha Rodes alone or with others shall be abd is hereby declared to Go and nre to the of the said Samuel Barker his heirs and assigns forever and to and for no other use intent or purpose whatsoever

Memorandum 27 Aug 1681
Memorandum that I Dame Martha Rodes of Barlborough in the County of Derby widow relict of Sir Francis Rodes late of Barlborough aforesaid Baronet rents gave this day accomodated with Samuell Barker of Barlborough aforesaid Carpenter and how was here due to him these summes following it is to say for money lent Three hundred & forty pounds for wages for him & his wife one hundred & eighty pounds & for his mans wages thirty pounds in all Three hundred & fifty pounds of lawful money of England for security whereof I have released him a conveyance of the Third of the Manor of Gateford in the county of Nottingham ______________________________________________________________________________ witness my hand the day and year above said
