To all to whom these present shall to me Samuell Barker of Barlborough in the County of Derby Gent sendth Greetings Whereas Dame Martha Rodes of Barlborough Hall in the parish of Barlborough aforesaid widow relict of Sir Francis Rodes late of Barlborough hall aforesaid Baronet deceased by her Indenture of Mortgage and of her hand and seal bearing date on or about the seven & Twentieth day of August which was in the year of our Lord God one thousand Six hundred Eighty & one And made between her the said Dame Martha Rodes of the one part And me the said Samuell Barker of the other part for the consideration therein mentioned & set & Grant Bargain & Sell unto me the said Samuell Barker & my heirs all that her third part of the Manor of Gateford in the county of Nottingham And all her third part of the messuages cottage houses edifices buildings barnes stables orchards gardens feedings commons profitt comodities wages paths passages water watercourses woods underwoods meadows pastures closes lands tenements & hereditaments whatsoever of her the said Dame Martha Rodes lying and being within the ________ precinct and Territories of Gateford aforesaid and all her third of all other lands & hereditaments whatsoever formerly conveyed to her the said Dame Martha Rodes and Ciprian Thornton of Grantham in the County of Lincoln Gentleman and Thomas Berry of Grayes Inn in the County of Middlesex Esquire and their heirs by Thomas Lane of London Gentleman To Have and to hold the said third part of the said Manor of Gateford aforesaid and of all & singular the before mentioned messuages lands tenements hereditaments and premises with these and every of them Appurtenances unto me the said Samuel Barker & my heirs & assigns for ever under a provisio therein contained that if the said Dame Martha Rodes her heirs Executors or Administrators or any of them did well and truly pay or cause to be paid unto me the said Samuel Barker & my heirs Executors Administrators or assigns the full and entire sum of Three hundred and fifty pounds lawfull money with consideration for the same at or upon the first day of September which shall be in the yeare of our Lord God one thousand Six hundred Eighty two That then the Indenture and everything therein contained shall cease & determine and be uttely void and of non effect to all Intents and purposes whatsoever Otherwise if default of repayment should be made The same to be inforce as by the aforesaid Indenture of Mortgage referenced being thereunto had it doth & may more fully & at large appear And Whereas the said Dame Martha Rodes after the day of the date of the foresaid Indenture by good & sufficient conveyance & assurances in the land hath given granted & confirmed all & every of the before mentioned properties set down and specified in the above mentioned Indenture of Mortgage with the appurtenances unto Sir John Rodes of Barlborough hall aforesaid Gent & Barronett Son of her the said Dame Martha Rodes To Hold the same unto him the said Sir John Rodes & his heirs for ever Now Know Ye that I the said Samuell Barker for & in consideration That the said Dame Martha Rodes hath satisfied & paid unto me The aforesaid sum of Three Hundred & fifty pound & all interest ___ to me for the same in full discharge of the principal & interest and upon the said mortgage the rec'pt whereof I the Samuell Barker do hereby acknowledge & thereof & of every part & parcell thereof do thereby & absolutely acquitt Exonerate for my self my heirs Executors Administrators & assigns & every of them release discharge & for ever quit claime and unto him the said Sir John Rodes in his full & pleaseable? possession and seize now being and unto his heirs Executors & Administrators & every one of them for ever by these present and for diverse other good causes & considerations me the said Samuell thereunto me being Have release released discharged and forever quit claimed exonerated her heirs and assigns forever All my Estate Right Title Property Interest reversion claime and demand whatsoever which I the said Samuell ever had or now have or which I my heirs Executors Administrators or assigns or any of us by anyway of or means of whatsoever hereafter may can or might have or claim of in or to all or any part of the above mentioned property So that neither I the said Samuell Barker nor my heirs Executors Administrators or assigns or any other person or persons whatsoever claiming by from or under it or any of it any right Title Interest claims or demands whatsoever for in or unto the same or any part or parcell thereof from henceforth may require claim challenge or demand But of & from the same & of & from all manner of action or actions of right Title Interest claim or demand whatsoever of m? or unto the aforesaid premises contained in the said mentioned Indenture of Mortgage or any part or parcell thereof said & are & henceforth shall be utterly barred & exonerated forever by these present And I the said Samuell Barker & my heirs all & every The aforesaid premises contianed in the above mentioned Indenture of Mortgage with the appurtenances & every part & parcell thereof unto him the said Sir John Rodes his heirs & assigns ag't me the said Samuell Barker & my heirs Executors Administrators & assigns & ag't all & every other person & persons whatsoever lawfully claiming by from or under me them or any of them shall & will warrant & for ever defend by these present And I do give in and deliver unto him the said Sir John Rodes The said released Indenture of Mortgage & do hereby empower him to cancell the same or otherwise defend thereof as he shall think fit
